Home building legislation

MEANING OF BUILDING WORK: Please note that you are required to disclosure building work that has been undertaken in the last 7 years. This includes works that may have been done by previous owners. Please note that "building work" includes building works that didn’t require a building permit and works that you may consider to be minor. There is also no value threshold on works that must be disclosed and includes works that were done by you or by a contractor. Building work includes, among other things for example, kitchen and bathroom renovations, re-stumping, re-roofing, replacement of windows, moving walls, and building or replacing pergolas, decks and sheds. If you are in any doubt about whether works done at your property should be disclosed it is extremely important that you please contact us to discuss further.


IMPORTANT INFORMATION IN RELATION TO BUILDING PERMITS: If you are unsure whether any (or how many) building permits have been obtained in the last 7 years it is possible for us to obtain a Building Certificate from the local Council which provides this information. These Certificates cost around $60 and take up to 7 business days to be processed. Please bear in mind that if you choose to order such a Certificate we will not be able to complete your contracts until the Certificate has been returned.

If you do not disclose to the purchaser all building permits that have been obtained in the last 7 years they could potentially avoid the contract. If you are unsure, to negate this risk, we suggest that you instruct us to order a Building Certificate on your behalf.

Material Facts:

It is an offence if a vendor knowingly conceals a material fact about land for sale, with the intention of inducing a potential purchaser to buy the land. Therefore please advise if you have knowledge of any of the following:

Prior tests or investigations which have revealed a defect in the structure of the building, a termite infestation, combustible cladding, asbestos (including loose-fill asbestos insulation) or contamination through prior uses of the land

Has there been a significant event at the property, including a flood, or a bushfire

Are there facts about the neighbourhood surrounding the property which may not be immediately apparent upon inspection (such as sinkholes, surface subsidence, development proposals) that would likely affect the use and enjoyment of the property to a greater extent than the usual disturbances and inconveniences of occupying land of the kind and in the local area of the land being sold

Has the property during the current or previous occupation been the scene of a serious crime or an event which may create long-term potential risks to the health and safety of occupiers of the land, such as:

  • extreme violence such as a homicide; or
  • use for the manufacture of substances such as methylamphetamine.
